Sia's contentious divorce just reached a whole new level of acrimony.

The "Chandelier" singer and her husband of two years, Daniel Bernad, filed for divorce in March, with Sia requesting legal and physical custody of their 1-year-old son, Somersault Wonder Bernad.

But in documents obtained by * *and filed in California Superior Court on Monday, Bernad is petitioning for sole custody of "Summi," claiming Sia is "an unfit and unreliable parent struggling with substance abuse and addiction" who is "incapable of providing safe or stable care" for their child.

Bernad's complaint enumerates all the reasons the healthcare executive believes that Sia should relinquish custody of Summi and consent to regular drug testing, six months of co-parenting classes, and a narrowly tailored visitation schedule (three two-hour visits per week).

But Sia filed her own documents on Tuesday, countering Bernad's claims as to her sobriety, questioning his own, and leveling a new, incendiary allegation. Sia's responsive declaration rejects Bernad's custody petition, noting "no emergency or exigent circumstances" warranting Summi's removal — and no evidence of that claim — as the child "has been and remains safe" in Sia's care.

Sia continues to claim that while she has been "sober for over six months" and remains in a treatment program that already requires weekly testing, Bernad maintains an "ongoing engagement in a nightlife and recreational drug-use lifestyle." The singer adds to the case against Bernad's custody request by claiming that he was previously under investigation "regarding illicit child pornography found on his computer hard drive," which her friend and assistant, Hayley Wood, allegedly discovered in a storage locker belonging to Bernad.**

Sia's declaration clarifies that while that investigation reached no conclusion, "Summi has never spent more than two hours in Dan's presence without Sia and/or a monitor present."

Bernad responds in his filing that Sia "planted" the alleged evidence incriminating him in a child porn investigation. "I had never even visited the storage unit that Sia and her employees acquired," he stated. "I vehemently denied any involvement with this alleged contraband," he insisted, pointing to the fact that Los Angeles County's Department of Children and Family Services closed the case on Sept. 23, deeming the claims "unfounded" and "inconclusive."

In addition to sole custody of Summi, Bernad, who notes that he is unemployed, is asking for $77,245 per month in child support, and for Sia to handle all medical expenses, educational and extracurricular costs, and related childcare costs.**
